Disputes

Any dispute relating to your visit to the website, to this Agreement, to our advertising or solicitation practices or to products you purchase through the website shall be submitted to confidential arbitration in Boca Raton, FL, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, Mela Artisans.com may seek injunctive or other appropriate relief in any state or federal court in the State of FL and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this Agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Please review our policies - Privacy, Returns, Shipping and Delivery, and others- all of which are incorporated herein by this reference and are posted on the website. These policies also govern your visit to the website. We reserve the right to make changes to the website, policies, and this Agreement at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Ordering Through The Site

Like most online retailers, after placing an order, you will receive an e-mail Order Confirmation. Please note that this does not mean that your order has been accepted. All orders are subject to acceptance by us, which are confirmed via an e-mail called Shipping Confirmation. A contract between us is formed at this point. The contract will relate only to those products whose shipment we have confirmed. We reserve the right to cancel your order at any time before we have accepted it and we may rescind our acceptance and cancel your order where there has been an obvious error in price or where the product is no longer in our inventory.

Pricing & Product Availability

Prices and availability of products on the website are subject to change without notice. Errors will be corrected as discovered. Our website contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our Website may be incorrectly priced. We are under no obligation to provide the product to you at an incorrect price if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a pricing error.

On occasion, you may be able to place a product in your shopping cart and submit your order for processing, but your order is subsequently cancelled due to unavailability of product. You acknowledge that products may sell quickly and there may be a short period of time after an order has been submitted, but where the product is no longer available. You agree that we may cancel your order after you have received an Order Confirmation without penalty.

On very rare occasions, you may receive a Shipping Confirmation from us, but the product is no longer available in our or our third party fulfillment provider's inventory. You agree that we may rescind our acceptance and cancel your order without penalty if we are unable to ship the product you ordered due to unavailability.

Risk of Loss-Shipping

All items purchased from MelaArtisans.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon tender of the item to the carrier.

Using Mela Artisans Credits

Should you invest in a microloan to an artist, your total loan amount, plus 10% bonus, will be repaid in 3 equal monthly installments in the form of Mela Artisans Credits. One Mela Artisans Credit is the equivalent of one US dollar. These Credits will be deposited in your Mela Artisans account and can be applied toward your next purchase of merchandise or microloans on the Mela Artisans site. To apply your Mela Artisans Credits towards a purchase, add the items you wish to purchase to your cart, proceed to checkout, and on the billing page you will see an option to enter the amount of “Total Credits Applied Towards this Order”. Indicate the total number of Mela Artisans Credits you wish to apply and the discount will be applied to your order. Purchases are deducted from your Mela Artisans Credits’ balance. If an order exceeds the amount you applied, the balance must be paid with a E Gift Card and/or credit card.

Sales tax is applicable on any merchandise purchased with Mela Artisans Credits. Mela Artisans Credits will not expire. Furthermore, Mela Artisans Credits cannot be resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law. Unused Mela Artisans Credit balances in a Mela Artisans account may not be transferred.

Using Promotional Codes

Add all items you wish to purchase to your cart and then proceed to checkout. In the Billing Information section, enter the Promotional code in the input box and press submit. If the promotional code is valid, your order will show the discount. If the code is invalid, an error message will display in red. It may not work if your coupon has expired, your order doesn’t meet criteria for the promotion, or you have already used a promotional code on the order. Promotional codes also do not apply to E Gift Cards.

Using E Gift Cards

E Gift Cards can be used for purchases by adding the item(s) you wish to purchase to your shopping cart and proceeding to check out. Under billing information, there will be an input box where you can enter the numerical code on your E Gift Card for redemption. After submitting this code, your order balance should indicate that the E Gift Card has been applied.

Sales tax is applicable on any merchandise purchased with a Mela Artisans e- Gift Card. Mela Artisans E Gift cards do not expire. Furthermore, Mela Artisans E Gift Cards cannot be resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law. Unused E Gift Card balances in a Mela Artisans account may not be transferred. Promotional codes also do not apply to E Gift Cards.

Product Display/Colors

We have made significant efforts to accurately display the colors of our products that appear on the website. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.

Termination of Use

We may terminate your access or suspend your right to access all or part of the website, without notice, for any conduct that we believe is in breach of this Agreement, is harmful to the interests of others or us, or is against the law. In addition, we reserve the right to refuse an order from any customer.
